Right, to expand on my “the DP excuse is a load of bollocks” post from last night. Essentially, under the DPA there are no hard and fast rules about what purposes you can and can’t use data for and it very much depends on what individuals expect it to be used for when it is collected. Some races say expressly that results will be published, but it’s so widespread (and indeed required in some cases ) that it’s straying into the territory of being an “obvious” use of the data which doesn’t need to be specifically flagged particularly as this isn’t “sensitive personal data”. Where it gets more complicated is that if they’ve specifically said up front that results won’t be published they may then need consent to move from that position, which is where they may be struggling now. This *isn’t* a DP issue as such, it’s the fact that their terms were badly drafted in the first place (or that they were deliberately drafted to prevent publication for some reason). The DPA didn’t require them to say that, but if they did they have to stick to it because publication wouldn’t be in accordance with the information given when the data was collected. Out of interest I’ve checked the ICO guidance on schools publishing exam results (they don’t have anything specific on race results but exam results are a similar issue – indeed more sensitive in some ways given that it’s children who have no real choice about whether to do exams or not). They say... “The DPA does not stop the publishing of examination results by schools, eg in the local press. But schools have to act fairly when publishing results and must take seriously any concerns raised.” They talk about telling people that results will be published but specifically say “In general, schools do not need peoples’ consent to publish examination results. But publication may sometimes cause distress or harm.” They then talk about dealing with objections – but this looks very much like opt out rather than opt in. [Where I do think it gets more fuzzy is results aggregators like Power of 10/Run Britain. I’ve never actually checked whether they only pull all your results together if you’ve created a profile and accepted their terms of use (which presumably include consent to do so) or whether they do it anyway. Power of 10 etc only create a profile if you are UK athletics registered etc or you create your own profile. 1,000s of names are present in results when you select the events full list but only people 'on' Power of 10 are collated in their rankings. PS I appear to have be blocked from posting on Edinburgh Marathon Fesitvals facebook page!!!! |

Interesting stuff Yorkshire Pie but their needing consent to move from a position doesn't hold as when I signed up there was no mention of keeping results private. The bit about not publishing results was added at least 5 months after GSI had started accepting entries for the 2014 event. |

Just been interviewed by local paper on this issue, they will be publishing my displeasure. I am now convinced that the position regarding results will not change, and unfortunately RunBritain will not accept the new stance, from a post on FB 'Just received this reply from Run Britain: "I'm afraid their updated hasn't changed the situation for us - unless the organisers make full results publicly available we can't include any performances from it, sorry."' |

I fear you are right Psimon, somehow I just can't see GSi changing their stance any further than what they've already done and, like you rightly point out, Run Britain.Power of 10 will not accept partial results. It's interesting to see where this leaves EMF in relation to the prestigious IAAF Bronze Race award, I suspect they'll rightly loose this for any future race as they've not fulfilled their current obligations. |

I also read somewhere that as an IAAF Bronze race that they should have had a clock car for leading lady, which they didn't. Not sure how accurate that requirement is, as there's lots of stuff being said at the moment, but sounds plausible.
